Rules For Challenge:

1. SPONSOR AND ADMINISTRATOR. This Challenge is sponsored and administered by Bowmar Nutrition LLC, 2310 SE Delaware Ave, STE G #294 Ankeny, IA 50021 (“Bowmar Nutrition”). The Challenge is in no way sponsored, endorsed or administered by, or associated with, Facebook and/or Instagram.
2. ELIGIBILITY. To participate in the Challenge, you must be at least 18 years of age or older and must be a legal resident of the United States of America or Canada* (exclusions apply). Officers, directors, and employees of Bowmar Nutrition and their immediate family members are not eligible to participate. The Challenge is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law.
3. CHALLENGE PERIOD. The challenge period shall begin on January 9th, 2023 at 12:00 AM EST and will close on March 6th, 2023, at 11:59 PM EST. Transformation Submissions will open March 6th, and close March 13th at 11:59 PM EST
4. HOW TO ENTER THE CHALLENGE: Before January 8th, 2023 at 11:59 PM EST, an eligible entrant must:

• Visit https://bowmarnutrition.com/pages/january-melt-challenge (“Website”), and complete and submit the registration form with his/her first and last name, Instagram handle, and email address, along with three (3) DAY ONE (1) photos, as well as the participants starting weight. The required photos must be a front, back, and side profile of the participant's body. Participants must be holding a sign with the hashtag '#BNMeltChallenge' with a timestamp of current date and time. Participants must wear either a bathing suit, or form fitting athletic wear.
• Purchase at least one MELT tub from https://bowmarnutrition.com/products/melt or place an order over $50 between December 30th, 2022 at 12:00 AM EST and March 6th, 2023 at 11:59 PM EST.
• Leave a product review on https://bowmarnutrition.com/ for any Bowmar Nutrition product between December 30th, 2022 at 12:00 AM EST and March 6th, 2023, at 11:59 PM EST. The quality and value of the product review will be judged when selecting a winner.
• Post a Photo or Reel to their Instagram profile feed between January 9th, 2023 and March 6th, 2023. Stories are welcomed, but a Post or Reel must be shared to the participants Instagram profile feed as part of their official entry. Only Post and Reel submissions will be judged when selecting a winner. Post or Reel needs to be original content created by the participant and have reference to the challenge. It cannot be a reshare or repost of Bowmar Nutrition's content.

5. WINNER SELECTION AND ODDS OF WINNING. Winner will be selected and judged by qualified judges, to be chosen by Sponsor, in their sole discretion and will consist of employees of Sponsor. The winners will be selected by the judges based upon the following criteria, in the judge’s sole discretion: (a) best overall body transformation and physical attributes; including weigh-ins and photos provided by the participant (70%), (b) sharing a Post or Reel created by the participant on their Instagram profile feed in reference to the Challenge (15%), (c) the quality and value of product review left on Bowmar Nutrition's website (15%).
On or around March 15th, 2023, ten (10) winners will be selected from all eligible submissions received during the Challenge Period. Ten (10) cash prize winners will be selected. Additionally, all eligible participants that complete the challenge within the requirements will receive one (1) $25 Bowmar Nutrition gift card. The winners will be notified by email within ten (10) days of the closing date.
6. PRIZE: All eligible participants shall receive one (1) $25 Bowmar Nutrition gift card. An additional ten (10) winners will receive a cash prize, plus a Bowmar Nutrition gift card. 1st place shall receive $6,000 cash, and a $1,000 Bowmar Nutrition gift card. 2nd place shall receive $2,500 cash, and a $1,000 Bowmar Nutrition gift card. 3rd place shall receive $1,000 cash, and a $250 Bowmar Nutrition gift card. *If one or more of the selected winners are legal residents from Canada, winner(s) shall receive their total grand prize in the form of a Bowmar Nutrition gift card.
7. PRIZE RESTRICTIONS. The following general conditions apply to the Prize:

• Prize is awarded “as-is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose);
• Each Prize winner will be solely responsible for all federal, state, and/or local taxes, and for any other fees or costs associated with the Prize he or she receives, regardless of whether it, in whole or in part, is used; and
• Lost, destroyed, or stolen Prizes will not be replaced.

8. PUBLICITY. Except for residents of Tennessee, by entering the Challenge, you consent to Bowmar Nutrition's use of your name, likeness, photographs, account name, biographical information, or statements for advertising or promotional purposes in any media whatsoever without any notice or payment to you.
9. PRIVACY. All personally identifiable information submitted in connection with the Challenge will be governed by Bowmar Nutrition's privacy policy, which can be reviewed here: https://bowmarnutrition.com/policies/privacy-policy
10. RELEASE. By entering the Challenge, you agree to release, discharge, indemnify, defend and hold harmless Bowmar Nutrition, and their officers, directors, and employees, from and against any claims arising out of, in whole or part, directly or indirectly, participation or attempting to participate in the Challenge or from acceptance, possession, use, or misuse of any Prize.
11. GENERAL CONDITIONS. Participation in the Challenge constitutes your unconditional agreement to these Official Rules and to Bowmar Nutrition's decisions, which are final and binding in all matters related to the Challenge. Bowmar Nutrition reserves the right to cancel, suspend or modify the Challenge, or any part of it, if any fraud, technical failures or any other factor beyond Bowmar Nutrition’s reasonable control impairs the integrity or proper functioning of the Challenge.
12. DISPUTE RESOLUTION. All disputes regarding the Challenge that cannot be resolved amicably between the parties will be resolved individually, without resort to any form of class action, exclusively before the appropriate state or federal court located in Los Angeles, California. California law will govern any dispute regarding the Challenge. In any such dispute, under no circumstances will you be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental, special, indirect, lost profits, consequential damages, or any other damages, including attorneys’ fees, and you further waive all rights to have damages multiplied or increased
13. MISCELLANEOUS. The invalidity or unenforceability of any provision of these Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Bowmar Nutrition’s failure to enforce any term of these Rules will not constitute a waiver of that provision. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Challenge-related materials, Bowmar Nutrition’s Privacy Policy, and/or the terms and conditions of these Rules, the Rules will control.
