1. SPONSOR AND ADMINISTRATOR. This giveaway is sponsored and administered by Bowmar Nutrition LLC, 2310 SE Delaware Ave, STE G #294 Ankeny, IA 50021 (“Bowmar Nutrition”). The giveaway is in no way sponsored, endorsed or administered by, or associated with, Facebook and/or Instagram.

2. ELIGIBILITY. To participate in the giveaway, you must be at least 18 years of age or older and must be a legal resident of the United States of America. Officers, directors, and employees of Bowmar Nutrition and their immediate family members are not eligible to participate. The giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law.

3. GIVEAWAY PERIOD. The giveaway submission form shall open on December 12, 2024, at 10:00 PM EST and will close on December 24, 2024, at 11:59 PM EST. 

4. HOW TO ENTER THE GIVEAWAY: Before December 24, 2024 at 11:59 PM EST, an eligible entrant must visit https://bowmarnutrition.com/pages/12-days-of-christmas-2023 (“Website”), and complete and submit the registration form with his/her first and last name, phone number, Instagram handle, and email address. Additionally, every order placed in the month of December will be tallied and increase entrant’s chances of winning.

5. WINNER SELECTION AND ODDS OF WINNING. On or around December 25, 2024, one (1) prize winner will be selected to win free supplements for a year, and thirty (30) prize winners will be selected to win $100 gift cards. The odds of winning will be random selection, additionally, every order in the month of December will be tallied and increase the entrant’s chances of winning. The winners will be notified via email.

6. PRIZES: One (1) winner will receive a $3000 Bowmar gift card via email. Thirty (30) winners will receive a $100 Bowmar gift card via email. 

7. PRIZE RESTRICTIONS. The following general conditions apply to the Prizes:

• Prizes are awarded “as-is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose);
• Prize winners will be solely responsible for all federal, state, and/or local taxes, and for any other fees or costs associated with the Prize he or she receives, regardless of whether it, in whole or in part, is used; and
• Lost, destroyed, or stolen Prizes will not be replaced.

8. PUBLICITY. Except for residents of Tennessee, by entering the giveaway, you consent to Bowmar Nutrition's use of your name, likeness, photographs, account name, biographical information, or statements for advertising or promotional purposes in any media whatsoever without any notice or payment to you.

9. PRIVACY. All personally identifiable information submitted in connection with the giveaway will be governed by Bowmar Nutrition's privacy policy, which can be reviewed here: https://bowmarnutrition.com/policies/privacy-policy

10. RELEASE. By entering the giveaway, you agree to release, discharge, indemnify, defend and hold harmless Bowmar Nutrition, and their officers, directors, and employees, from and against any claims arising out of, in whole or part, directly or indirectly, participation or attempting to participate in the giveaway or from acceptance, possession, use, or misuse of any Prize.

11. GENERAL CONDITIONS. Participation in the giveaway constitutes your unconditional agreement to these Official Rules and to Bowmar Nutrition's decisions, which are final and binding in all matters related to the giveaway. Bowmar Nutrition reserves the right to cancel, suspend or modify the giveaway, or any part of it, if any fraud, technical failures or any other factor beyond Bowmar Nutrition’s reasonable control impairs the integrity or proper functioning of the giveaway.

12. DISPUTE RESOLUTION. All disputes regarding the giveaway that cannot be resolved amicably between the parties will be resolved individually, without resort to any form of class action, exclusively before the appropriate state or federal court located in Los Angeles, California. California law will govern any dispute regarding the giveaway. In any such dispute, under no circumstances will you be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental, special, indirect, lost profits, consequential damages, or any other damages, including attorneys’ fees, and you further waive all rights to have damages multiplied or increased

13. MISCELLANEOUS. The invalidity or unenforceability of any provision of these Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Bowmar Nutrition’s failure to enforce any term of these Rules will not constitute a waiver of that provision. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any giveaway-related materials, Bowmar Nutrition’s Privacy Policy, and/or the terms and conditions of these Rules, the Rules will control.
